Q: I heard the government released an updated model HIPAA Notice of Privacy Practices. What is the HIPAA Notice of Privacy Practices and when do employees receive it?

A: The HIPAA Notice of Privacy Practices explains how a health plan may use and disclose protected health information (PHI) and describes participants’ privacy rights under HIPAA. The notice is typically provided by the health plan or insurance carrier when an individual first enrolls in coverage. Health plans must also remind participants of the availability of the notice and how to obtain a copy at least once every three years and distribute an updated notice if there is a material change to the plan’s privacy practices.
