Most employers will have to transmit their 2023 Forms 1095 to the IRS electronically.
The IRS has updated ACA filing requirements for the 2023 tax year, impacting how employers submit Forms 1095. Beginning this year, employers with 10 or more of any tax form must electronically send Forms 1095 to the IRS. This marks a departure from the previous electronic filing threshold, where electronic filing was mandated only for employers with 250 or more Form 1095 returns.
The 10-or-more criterion is determined by aggregating all forms required for filing with the IRS, encompassing not just Form 1095 but also Form 1094 and other information returns like W-2s, 1099s, and income and excise tax returns. Employers facing undue hardship in electronic transmission may apply for a waiver from the IRS, though cost factors into the waiver request.
